A collective agreement creates rights and obligations for both parties in the workplace. And because there are rights and obligations, there must also be remedies for breaches so that rights and obligations are legally enforceable. The parties to a contract are the only ones who can legally enforce it. Although many members of the baraining unit do not realize it, they do not have individual rights to enforce the agreement when alleged breach affects them. Provisions typically included in a collective agreement: pg 153. Cola (cost of living adjustment): usually an annual percentage increase in salary during the life of an agreement to cover inflationary increases in the cost of living. Sunset clause: a clause that requires removal of disciplinary notices from an employee"s personnel file after passage of a prescribed period of time, provided there are no further infractions. One party alleges a breach of the collective agreement by the other.
