LAW 122 Chapter Notes - Chapter 5: Intentional Tort, No Liability, Convenience Store
Document Summary
Conspiracy: usually occurs when two or more defendants agree to act together with the primary purpose of causing the plaintiff to suffer a financial loss. No tort if one person deliberately inflicts an economic injury on another. Same act may trigger liability if it is performed by several people working together. Courts are reluctant to find that the defendants co-operated for the primary purpose of hurting the plaintiff. If defendant"s actions were otherwise lawful, then conspiracy is difficult to establish because the court will require proof that the defendant"s primary purpose was to hurt the plaintiff. If defendants conspired to perform an otherwise unlawful act might agree to commit a tort, or to violate the criminal code, labor relations legislation, or licensing regulations. Disruption of contract between plaintiff and a third party: risk management. Direct inducement to breach contract: directly cause breach with plaintiff. Convince customer to break agreement, or employee to quit job.
