If the accused doesn"t appear, the judge can issue an arrest warrant: appearance notice. 2: the release by a judge or jp of a person who has been charged with a criminal offence pending court appearance, can be brought to bail court within 24 hours. If arrest warrant was issued by jp, the police must bring the arrested person before a jp, unless release was authorized when warrant was issued. Fitness to stand trial: during early stages of court process, a lawyer may suspect that their client is suffering from a mental illness. The case for the crown: trial begins with the prosecution calling witnesses and presenting evidence in support of the position that the accused it guilty, testimony of the complainant may be the crown"s key evidence. It is the task of the crown to prove guilt of an accused beyond reasonable doubt; if the crown fails to do this, there can be no conviction.
