Document Summary

Intentional tort: an action intentionally undertaken by a person that causes injury or damage to another, rather than careless, conduct. For certain intentional torts the intention must have been to injure or damage another; For other intentional torts the intention must have been only to act in a certain way (not necessarily to cause injury or damage to another) Assault: tort occurs when the tortfeasor intentionally causes the plaintiff to reasonably believe that offensive bodily contact is imminent: belief: not based on physical contact, only on reasonable belief. Contact: "bodily contact" need not strictly apply, enough that tortfeasor makes contact with plaintiff (clothing, held items) or if tortfeasor causes something to touch plaintiff. Invasion of privacy: not a general tort. Indirectly protected by: trespass to land: trespassing on private property, breach of confidence: publishing unauthorized information/photographs without plaintiff"s consent. Intentional infliction of mental distress: acted in outrageous or unjustified manner. Intended to cause emotional distress or callously disregarding that possibility.
