The Enhancement of HR Thru Mediation and ADR

● Rule of Law: free from arbitrary treatment from any government representative, to be
seen in front of a court, uncorrupt tribunal, people will be held accountable under the
law.
● HR and UDHR are critical to establishing a society.
● Mediation v Litigation
○ Mediators are trained to resolve conflict between 2 or more groups. Essential for
people who cannot afford court or their cases are backlogged in the system.
Provides an immediate solutions.
● FSRI Mission (est. 2012)
○ Completely volunteer based
○ Building quality, sustainable mediation centers; run by host nations
○ Assessment, implementation, quality review
○ Cultural tailoring/system design so that they do not collapse after FSRI leaves.
● Under the current systems….
○ Denial of access to justice/ peaceful and timely dispute resolution.
○ Parties resort to self-help: bribes, extortion, thugs, corruption.
○ Civil disobedience, disregard for ROL distrust of government/democracy.

Ex: california enforces mandatory court referral which calls for a mediation session before actually going to court.
