In the body of the u. s. constitution, we, the people of the united states grant to the national government certain powers in order to make and preserve a better, stronger, safer, and more verdant social and political society. In the bill of rights, the first 10 amendments to the constitution, the people set specific limits on the exercise of those powers by the national government. The first amendment forbids congress to abridge the freedom of speech. It doesn"t specifically define which speech is included within the freedom of speech and, therefore, protected from government abridgement and the speech that we are not free to speak speech that may be abridged by government. Those distinctions are being sorted out by the supreme court on a case by case basis over the last two centuries and continuing. The bill of rights is made up of specific prohibitions on federal government action. Liberty refers to freedom from government intrusion upon your actions.
