Human beings = rational and free-willed: can be held responsible for actions, governed by principle of utility: seek pleasure/happiness and avoid pain. Punishment based on social harm of act and not intention of offender: like offenses receive like punishment, punishment fit crime and not criminal. Goal of punishment = primarily crime prevention, secondarily retribution for harm caused by offender: to prevent crime, punishments should be just severe enough for pain/ unhappiness created to outweigh pleasure/happiness from crime. Offender decide crime does not pay and thus deterred from future violation of law. Certainty and swiftness of punishment > severity.
