When the youths approached the defendant, who was carrying an unlicensed pistol, responded by systematically firing shots severely injuring the youths. He later surrendered to the police and stated in a confession that when the youths approached him to ask he was in fear based on prior experiences, and pulled out his handgun and fired systematically. After firing some rounds, one which missed one of the youths he proceeded to fire injuring the youth severely. He freely admitted that the youth shad to be murdered and pay. He also said that if he had more bullets he would have put a bullet through the last youth"s head.
