Document Summary

Jury pool: mentally competent, english-speaking, adult citizens, not convicted of felony, living in relevant jurisdiction: 1968 act required jury pool be based on voter registration. Venire: people who actually show up: only about 80% show up, voir dire: interview process to determine significant biases. 6th amendment guarantees a right to an impartial jury . Voir dire is the process by which attorneys select, or perhaps more appropriately reject, certain jurors to hear a case . Judge has a lot of discretion in the process. Challenge for cause- remove juror when there is a clear reason to suspect. Preemptory challenge (aka strike)- can eliminate prospective jurors without partiality and un-objectiveness articulating a reason. Why not get rid of preemptory strikes: time consuming, inherently bigoted and abusive, attorneys can alienate jurors from tough questioning, 3 purposes: symbolic fairness, attorneys can indoctrinate jurors about the facts of the case. Jury: group that survives the voir dire process.
