Kim davis, a county clerk in kentucky, refused to issue marriage licenses to gay couples, on grounds that it was in violation of her religious faith. Laws forbidding discrimination by race- raised religious objections to those laws. Laws forbidding discrimination by sexual orientation and gender identity- religious objections again. Free exercise clause-- what does this consist of and where do we draw the line. 1870s- first decision of free exercise- mormons- reynolds v. u. s. (1879)- married to one person and no more at a time. Upholds federal law against polygamy---but it still continues to exist. Distinguished religious belief (protected) from conduct based on belief (not protected) Sherbert v. verner (1963)-- overturns denial of unemployment benefits to 7th day. Religious beliefs are good cause for an exemption. Wisconsin v. yoder (1972)-- compulsory school attendance law violates 1st amendment right of amish. Did not want to send their children to high school--viewed high schools as a corrupting influence.
