MGMT 209 Lecture 11: Tort Law

20 views4 pages

Document Summary

A tort is a civil wrong, not criminal! But can be the same thing as criminal, we"re not discussing that though: worried about the damages caused civilly, three categories. If you can prove they were put in fear, it is assault: still assault if the perpetrator can"t do it, battery. Judge scares you about prison horrors - can be ok: self defense, any force reasonably necessary to protect yourself. Including, if necessary, deadly force: can only use deadly force if it is used against you, cannot use deadly force to protect property, only yourself or someone else. If they enter the house, you have the duty/right to flee. Tx has another standard: problem - what"s too much force, false imprisonment. Intentional holding of a person within boundaries: defense, shopkeeper. Intentional infliction of mental distress: hard to prove. Invasion of privacy: unwarranted public exposure, unauthorized! If you"re arrested - that"s public record: business issues.
