Laws take so long to catch up to new technology, there was no law against stealing an airplane, charged with stealing a motor vehicle. Very important to convict someone under appropriate statute in order for sentencing to be correct. Had pictures of magazines with child pornography, kept images of children in a folder, threw out the rest of the magazine. Charged with possessing three or more books, magazines, periodical, etc. of matter that can depict child pornography. These individual pictures aren"t books, magazines, periodicals, etc. Which made the dif culty of charging him, the government argued that the paper the pictures were printed on were the matter. Talked about whether a fetus was a human (pre roe v. wade), a lot of cases had certain undertones that tried to tilt the eld towards/away the consideration of the fetus being a person. The defendant attacked a pregnant woman and tried to kill her unborn child.
