Diversion Programs
Offenders can be diverted from the criminal justice process at several points: pre-charge, post-charge,
and post-sentencing; keep offenders from being processed further; requires offender to accept
responsibility for offending and agree to fulfill certain conditions
Netwidening
Potential, unanticipated consequence of diversion in which persons who would otherwise have been
released outright by police or not charged by Crown counsel are involved in the justice system
Coercion
Offenders surrender basic procedural rights to access programs (ex. Drug treatment programs)
Probation
A sentence imposed that provides for the supervision of the offender in the community by a probation
officer, either as an alternative to custody or in conjunction with a period of incarceration
Conditional Discharge
Offender is found guilty and released on the condition that he/she will comply with the conditions of a
probation order;
if fails to meet the conditions he/she may be returned to court to be sentenced on the original charge
Suspended Sentence
Offender is convicted of the offence; imposition of the sentence is suspended pending successful
completion of probation; will have a criminal record
Conditional Sentence
Offender receives a term of confinement less than 2 years and is allowed to serve it in the community
under the supervision of a probation officer, provided he/she meets certain specified conditions
Intermittent Sentence
Sentenced to incarceration/jail; generally served on weekends; subject to probation order with specific
conditions; available only for sentences that do not exceed 90 days

Conditional Release
Generic term for the various means of leaving a correctional institution before warrant expiry whereby
an offender is subject to conditions, that if breached, could trigger revocation of the release and return
to prison
Qualifications for Conditional Release
The offender will not by reoffending, present an undue risk to society before the expiration according to
law, of the sentence the offender is serving; and, the release of the offender will contribute to the
protection of society by facilitating the reintegration of the offender into society as a law-abiding citizen
Sex Offender Registry
Require offenders to register 15 days before release into the community or on conviction if they receive
a non-custodial sentence, to re-register annually, and notify 15 days before any address change;
includes names, date of birth, current address, identifying marks, photographs
Intermediate Sanctions
a term used to describe a wide range of correctional programs that generally fall between probation and
incarceration, although specific initiatives may include either of these penalties as well
Risk Principle
correctional interventions are most effective when matched with the offender's level of risk and higher-
risk offenders benefit from interventions more than medium and low-risk offenders
Need Principle
to be effective, correctional interventions must address the criminogenic needs of offenders
Responsivity Principle
correctional interventions should be matched to the learning styles of individual offenders
Intensive Supervision Probation
an intermediate sanction that generally includes reduced caseloads for probation officers, increased
surveillance, treatment interventions, and efforts to ensure that probationers are employed
