PSCI 1101 Lecture Notes - Lecture 6: Senatorial Courtesy, Earl Warren, Missouri Compromise
Document Summary
Court stopped imposing restrictions on government regulation o it didn"t even overturn congressional enactments that violated personal liberties o. After 1937, it was protection that liberals preferred the revival of state. The constitution only requires the supreme court; all others are creations of congress. Constitutional court: a court exercising the judicial powers in article iii and its judges are given constitutional protection: can"t be fired, salaries can"t be reduced. Legislative court: set up by congress for some specialized purpose and its judges are not given constitutional protections. Party affects how judges behave, but not entirely. Facts of the case, prior rulings, arguments presented by lawyers, no reliable way of predicting how the judge will act. Sex, and race have become prominent factors in selecting judges. President nominates a qualified individual, and the senate approves or rejects the individual based on these qualifications. Often, the president asks the senator to recommend someone.
