THE LEGAL SYSTEM AND THE MENTAL HEALTH SYSTEM
Abnormal psychology and the law.
The DSM is meant to standardize things.
The legal system is trying to clear fast rules about who should or shouldn’t do something.
Treatment
1. When someone needs treatment but does not want it. When is it appropriate for society
to make someone or compel someone to get treatment?
○ Civil Commitment - involuntary hospitalization. For someone to be involuntarily
hospitalized, they need to present an immediate danger to themselves or others
and a medical doctor needs to certify this → taken to mental hospital against your
will
i. This is important so they don’t danger others or themselves
ii. You can also have a trial before a judge to have a legal proceeding.
iii. Someone who can’t take care of themselves
iv. What rights does someone have within and for treatment?
1. For treatment: mental disorders have to be equal with medical
disorder in order to get insurance
Mental Disorder Preventing Person from doing something
1. Working or maybe they need accomodations while at work
○ This is where disability claims come in
2. From being able to stand trial if they are accused of a crime
○ Ex: if you are actively hallucinating
○ This does not assume that the person was having a mental disorder during the
crime they committed
3. Determining right from wrong or to act on that determination
○ Mental illness that prevents them from being able to NOT still or NOT kill
someone etc.
i. This is where the insanity defense comes in
ii. These are impairment disorders
