Title vii of the civil rights act of 1964 - it is illegal for employers to discriminate on the basis of: race; color; religion; sex; national origin. Americans with disabilities act (ada) - protest against disability discrimination. Age discrimination in employment act (adea) - protects against age discrimination for those. Disparate treatment: treated differently because of membership in a protected category. Step 1 - plaintiff presents evidence that he belongs to a protected category and was treated differently from other similar people who are not in the protected category. Step 2 - employer must prevent evidence that its decision was based on legitimate, nondiscriminatory reasons. Step 3 - to win, plaintiff must prove that the employer intentionally discriminated by showing that the reasons offered were false (pretext) and the real reason was motivated by discriminatory motive or animus.
