Every individual is equal before and under the law, and enjoys equal protection and benefit of the law without discrimination. Categories of discrimination outlined by the provision include: Subsection (2) makes clear that the rights does not preclude the development of programs whos aim is to ameliorate conditions of disadvantage on the basis of these particular categories. There may be compelling public objectives necessitating limitations on individual rights. The test that counts have adopted to determine whether through a law or government action is found to be in violation of a charter right, is nevertheless a reasonable limit on that right. Allows for either federal parliament or any of the provincial legislatures to enact laws that, though found to be in violation of. A way for legislative bodies to immunize a given law from judicial scrutiny. Does not apply to all interactions involving the violation of a persons rights, it holds between the government and the individual.
