PO210 Lecture Notes - Lecture 2: Vise, Critical Legal Studies, Critical Race Theory
Document Summary
It is sometimes thought that theory can be divorced from lived reality -- that its practical applications are both contrived and dubious. Law provides us with a very good example of how theory in fact informs practice (and vise vera, of course). When we reflect on whether a law is a "good" or "just law" i. e. we inevitably draw on theoretical considerations concerning what makes a law "good" or "just" in the first place. Equipping oneself with a strong theoretical base will allow more dexterous navigation of complex policy problems. Furthermore, understanding the strengths and weakness of any particular application at least partially depends on understanding the available alternatives. Nlt and lp are competing theories for legal validity. They offer a response to the conditions under which a law is validly applied or enforced. Nlt trades on the obvious linkages between law and morality.
