The third criterion requires having an irremediable and grievance medical condition which includes having: an incurable illness; an advanced and irreversible state of declined capability; psychologically-induced suffering; and a foreseeable natural death. As a clinically depressed patient, who expresses consistent intolerable despair, she meets all the criteria except a foreseeable reasonable death. Bosscher has the potential to live the average life span, even though she is unresponsive to her psychiatrist"s treatment, because she would most likely not progress nor decline by developing a disease or disability.
