We discussed how weijer and colleagues argue that the medical standard of care circumscribes patient choice in the clinical setting. This week we consider the role of the physician"s duty of care when an experimental drug is offered in the context of a clinical trial: protect and promote the patient"s care. B/w unequal parties: defined by structural inequality (b/w doctors and patients; teachers and students; Transfer of authority over a significant practical interest, such as medical, legal or financial interests. Definition: relationship of structural inequality in which the fiduciary is granted discretionary power over a significant practical interest of a beneficiary.
