Jury is only needed in more serious cases. Function of the jury: to make a verdict, the juries task is to decide which of two contested realities are real. Jury decides of guilty or not while judge decides on sentencing. Jury can decide sentence on 2nd agree murder (degree of responsibility) Jury = 12 jurors (canadian: decisions are made solely on admissible evidence, must have unanimous verdict, however, can continue with no more than 2 members excused, most only use facts of the case, and laws supplied. Serve as guardian absent rigid law: they apply their own sense of fairness without justifying decision. Symbolic significance: their verdict can be a message from community to government. In the us there can be as little as 6 jury"s: size does(cid:374)"t matter but there are some caveats: Likely to be hung: this is bad bc it means they did not deliberate will.
