CRI215H1 Lecture Notes - Lecture 2: Legal Realism, Trailer Park, Social Fact
Document Summary
The semi-autonomous social field has rule-making capacities, and the means to induce or coerce compliance; but it is simultaneously set in a larger social matrix which can, and does, affect and induce it, sometimes at the invitation of people. Formal rules: union rep, health and safety of the workers, work hours and etc. Informal rules: jobber give gifts to union rep (so union rep can side with the jobber) Moore recognises information that she gives may not be agreed by other parties. If the contractual structure between formal and informal laws did not exist, union rep would not exist. Contractors usually have a more flexible approach when it comes to rules and payment because jobber needs to sell products first before getting revenue and paying contractor. If contractors were to be strict, jobber would hire different contractor next time. Connection between formal laws and the non-legal mores of the social field.
