Beccaria says there should be a system of written rules, also he thinks that this code should be taken strictly and judges should not deviate far and flexible. Beccaria would agree with judges who say that they interpret law strictly, and if you find a problem with it, you fix it through democracy and the parliament. Beccaria is very concerned about judicial discretion and about giving judges too much power. R. v. fedoruk was a dispute between someone and a homeowner, and one night him and his wife shrieks, looks out the window and sees frey. Fedoruk detains frey until the police arrives.
