The vienna convention on the law of treaties of 1969 (vclt) is the main instrument that regulates treaties. It defines a treaty and relates to how treaties are made, amended, interpreted, how they operate and are terminated. Vclt definition of treaty: definition of all treaties, a marriage proposal is a kind of promise but not legal whereas marriage = legally binding obligation. Int law has rules regarding legally enforceable rules. Treaties establishing international organizations for e. g. un - its constituent charter is considered a treaty and can be governed by vclt. Treaties regulating membership vis- -vis organization - it regulates relationship among those states that make up int organizations. Icj said looks like legally binding treaty and says u can bring to icj and that"s what happened here: oral agreements not properly treaties = can give rise to customary law. It is part of the treaty which a contracting party either excludes or modifies with respect to that party"s obligation.
