Lecture 6: jury selection and the challenge for cause. Jury functions: 1: to use the wisdom of 12 (regular, honest, hardworking citizens) to reach a verdict, duty to engage in jury duty if summoned to do so. Juries at time need to have an expert witness come to give testimony or opinion evidence to increase knowledge. Empanelling a fair jury: 2 general rules/theories, 1: representativeness, voter registration + enumeration lists, gender, race, socio-economic status, biased to be, older, more likely male than female, but this is changing now, race. If don"t fill it out, less likely to fill out/to be called. Students less likely to be called because don"t live at home while attend school: voter registration list, people who have registered to vote, have ethnic + class biases. In canada, most cases are judged w/out a jury: most cases are going to be summary offences --> won"t have jury, judged by judge.
