Fallacies are more of a logical error while rhetorical is more emotional. Deals with the relevance of the premises to the argument. Claim to be giving support to a conclusion but are not. The person making the claim demands that you prove it false. The person who argues something should prove the argument. Only the person making the positive assertion has the burden of providing the evidence. Three things we look for when faced with this argument. The less plausible the claim the greater the burden of proof. Whether you are making an affirmative or positive claim. Is something the case or there is no evidence for it. Saying there is no evidence for something is less of a positive claim. Usually in law, if you are the one suggesting a change in how the law should be read you have a greater burned of truth. In some situations, we have special circumstances with the burned of truth.
