Lecture 1
When doing a case study
• Look for facts
• Identify the legal question
• Identify the legal principles (law area)
• Apply these legal principles
• Take a decision
What is law?
• set of rules made by an official authority
• to maintain order in society
• to allow people to live in harmony
Executive branch
Judicial branch (independent branch)
• role: resolve judicial issues
• Judges are named by the provincial or federal government, they are independent from that
government and can not be influenced.
• They can make decisions that are opposite to the interests of the government
Legislative branch
• Represented by House of Commons and Senate
• 1st reading (tabled): presenting a piece of legislation we would like to see applicable in
Canada
• 2nd reading: opportunity to debate on the bill and vote on whether or not the bill will go to the
next step
◦ bill goes to a committee for study composed of government members, the opposition
and all other parties
◦ if approved, goes to the 3rd reading
• 3rd reading (tabled): bill goes to the Senate who repeats the same process
• if Senate agrees, the bill has to be proclaimed in force by the executive branch + ceremony
Constitution Acts
if a bill goes against this, it is not put in place and is declared unconstitutional
The Constitution Act, 1867
• first constitution of our country
• provides the legislative framework for the federal and provincial government
◦ Provincial: narrow focus specifically on their province - hospitals, housing, mariage
◦ Federal: includes province to province trades
• Immigration, agriculture
• Other issues like the environment that are not in the constitution, both provincial and federal
government can work together
◦ if there’s an issue, the federal government wins
• Was made in England that could not be amended
