Understand the diferent sources of employee rights in the law of employment. The rights and obligaions of employers and employees are determined irst by the terms of employment contract. Common law of employment: the body of case law in which courts interpret employment contacts and the legal principles taken from those cases that guide the interpretaion of employment. Common law judges have to develop a long list of implied contract terms: terms judges read into employment contracts when the writen contract does not expressly deal with the mater. Over the past century canada has intervened by passing a large variety of legislaion aimed at inluencing the employment relaionship. Statutory regulaion operates alongside common law, coexising with it but also oten modifying it. Collecive agreement: an employment contract between an employer and a union that sets out the terms of employment of a group of the employer"s employees represented by the union.
