Rape not a legal term: replaced by 3 levels of sexual assault. Least severe (level 1) assault = 98% of charges: police seek lesser charges because they are easier to prove. Women need to be beaten badly enough before the criminal justice system responds . Take another look at the transition to capitalism: major socio-economic shift, changes women"s position in relation to law. Less of a sexual division of labour: production of goods and reproduction both important to sustaining family, domestic labour more valued. Also process of social enclosure for women: relegated to private realm. Devaluation of reproductive labour: not linked to money economy. New type of independence led to new types of controls and monitoring: more dependent on men as wage-earners. Limits on women"s legal responsibility lifted only in certain cases: punishable legal adults when it came to governing reproduction. Some women"s labour is governed: type of work, where, when, how long they can work.
