Document Summary

In order to get someone declared dead when no body has been found you have to wait 7 years before you can apply for a presumption of death. Lucid interval = time that an ill person can make out a valid will (ie in the morning when she is more competent) If a person is non compos mentis they are unable to make a will: marriage voids a will execption: if when you were single that will was made in. Contemplation of marriage = one that refers to a specific marriage that is going to take place, time place etc (that will will survive the marriage) The wills act: anyone can make up a will. There are two requirements to make a will (1) must be 18+ years of age, (2) compos mentis of sound mind. If don"t know what you are doing then would be non compos mentis which means not of sound/full mind.
