Chapter 1 the law and the legal system. Law is a predictable system of rules enforced by courts. If we were good people, we wouldn"t need law. Three functions of the law: settling disputes, establishment of rules to bring order and minimize conflict, protection of one"s self, possessions, ideas. Law body of rules of conduct that are obligatory. Sanctions imposed if a rule is violated. Social control using laws to shape society. Definitions: society"s rules and processes that try to create fair and predictable outcomes in our relationships, rules of civil conduct. Policy the ethical/moral/social reason (goal) behind the law: usually based on culture and religion, seeks to create a harmonious society, historical in nature vast differences in culture create vast differences in law. The nature and quality of self rule. Implies boarders and wide recognition of an autonomous state: usually a function of the acceptance of other sovereign states.
