Document Summary

Crim 332 week 6 (oct 13, 2016) Law is but one strategy and is limited in enacting broader social change/transformation. Yet, the law can spearhead reform, make amendments, reflect shifts in public attitudes (abortion, same sex marriage, euthanasia) Question: when does the law (ovl) have juridogenic effect whereby in exercising law, we may have effects that make conditions worse (comack, 2014: 62) Bill c-36: the protection of communities and exploited persons act. Issue: laws do not address the root causes and pathways that lead many into the sex trade (vogel, 2015) Controversy: prostitution framed as a model of harm-reduction (public health & safety) vs. a legal issue and, more so, a moral issue. Harm, exploitation, sexual agency, coerced choice, gender inequality. Sex wars (since the 80s): different perspectives among feminists, women"s groups, activists. No unified position by feminists: female sexuality, pleasure vs. oppressive structures/practices. Role of law & social control: protect women, minimize harm, legislate morality.
