Structured through social & political ideologies - vary across time & cultures. However, there are harmful sexual acts that most nearly every community agrees are illegal. For most sexual offences, must be lack of consent on part of victim & some level on intent on part of offender. Act is result of force, threat, or duress. There was clear/implied statement of unwanted sexual advances/acts. There are some acts that are consensual but still illegal. Pseudosexual act primarily motivated by male desire for dominance. Sexual assault = systemic to patriarchal society of conditioned male supremacy. Sexual gratification not seen as main motivation. Seen as conditions of society being male dominant. Gendered nature of law/political response to sexual and domestic violence. Research on sexual offending w/i its social context. Lack of empirical scope - theory hard to test. Patriarchy & role of state in maintaining patriarchal relations that are abuse-supportive.
