Section 11(1): the insurance plan applies to every worker who is employed by a schedule 1 employer or a schedule 2 employer. Section 11(2): subject to section 12 and 12. 2, the insurance plan does not apply to workers who are executive officers of a corporation. Section 12(1): upon application, the board may declare that any of the following persons is deemed to be a worker to whom the insurance plan applies: (cid:1005). The board may make the declaration only if the executive officer consents to the application. Much of section 12 has been amended recently to deal with the mandatory inclusion under wsia of independent operators in the construction industry. Section 13(1): a worker who sustains a personal injury by accident arising out of and in the course of his or her employment is entitled to benefits under the insurance plan: presumptions.
