Occurs when two or more defendants agree to act together with primary purpose of causing the plaintiff to suffer a financial loss. Conspiracy is hard to establish if the defendants actions were lawful. Occurs when the plaintiff suffers loss as a result of the defendant"s threat to commit an unlawful act against either the plaintiff or a third party. Two-party intimidation: occurs when the defendant directly coerces the plaintiff into suffering a los: ex: supermarket owner may use threats of physical violence to frighten the owner of a small convenience store into closing down. Three-party intimidation: occurs when the defendant coerces a third party into acting in a way that hurts the plaintiff: union threatens the company with an illegal strike unless it fired the plaintiff. 1st, the plaintiff must prove that the defendant threatened to commit an unlawful act (crime, tort, or even breach of contract).
