Why study law: business decisions, legal factors of profit & loss, effects on success and failure in business, ex. Contracts: actions have legal binding, good or bad, risk management. It"s a set of pri(cid:374)(cid:272)ipals a(cid:374)d rules that are e(cid:374)for(cid:272)ed i(cid:374) the (cid:272)ourt of la(cid:449) There is a way of thinking/reasoning for the principal and rules. Its not important who wins the case but the reasoning. Ethical reasoning focuses on what is ethically right or wrong regardless of the law. Class 1: comes from ancient rome, code based, used in france, most of europe and quebec. Common law: comes from england, used in the commonwealth. Some laws are the same across canada: ex criminal law & constitutional law. Hierarchy of source of law: constitution, legislature, court. The constitution: basic rule for society, including legal and political systems, highest source of law, difficult to amend.
