History of insanity verdict in law: the canadian criminal code (c-30) of 1992: Not criminally responsible on account of mental disorder (ncrmd) Raised by defense, argued by crown the issue of the criminal responsibility of the defendant raised by defense council; can be questioned by prosecution. Ocassionally, after defendant has been found guilty without a plea of ncrmd crown themselves may raise point that individual should be assessed. Proof standard: beyond a balance of the probabilities : aka beyond a reasonable doubt standard is not applied in the standard of criminal responsibility, if majority of evidence suggests lack of guilty by mental disorder, then we find. Ncrmd (whereas beyond a reasonable doubt = a way tougher standard) If ncrmd found = unconditional release unless defendant poses risk to the public. Review boards oversees the disposition / release of the ncrmd defendant. Clinical interview (structured or unstructured: the classical assessment tool; almost always used, sads (schedule for affective disorders and schizophrenia)
