We can think of the criminal law as willing to punish someone only if one of the following 2 conditions are meant. It"s possible to suppose that their choice comes from a pre-existing character. If failing to punish this person"s choice might cause them to develop a tendency towards criminal behaviour. Duff seems to have succeeded in providing us with a new and improved theory of criminal responsibility. Descriptive-explanatory projects: an attempt to accurately describe and explain some part of the world. Normative projects: attempts to determine how we ought to behave in the world. We"re going to look at the very best answers for why we might punish someone, and look at problems for those answers. Near the end of the course, we will consider reasons for why we shouldn"t be doing this.
