Document Summary

1b03 lect. nov 23 the moral force of law: (plato and thoreau) Questions of connection between law and morality. When law tells us what to do vs moral/conscious tells us. Even if you disagree with law, you should follow it. Or should not follow it if its immoral. Socrates wrote that we should always follow law bc: we have a relationship of obligation towards the state, we entered an implied contact by not leaving the state, we had the opp. to change law within. Socrates says the state devotes resources into us, therefore we should follow law. If we do not like laws, we can leave but if we stick around, we are saying we consent with law. If we don"t like the law, we can change them. Plato says we shouldn"t break the law. Believes we have a right to assume what we want if it is good and not to respect the law over our morals.
