Justice as historical also known as the entitlement theory, viewing justice as historical. Remember nozick offers a non-patterned theory of justice. Mill the criterion is utility: a just state is one that produces the greatest happiness / wellbeing for the greatest number of people. Nozick the criterion is historical: just need to look at a cause of history about how a issue came about to see if it is indeed just or not. In looking at the history of a state of affairs to see if it is just, we look at : justice in acquisition , justice in transfer. In a free society, diverse persons control different resources, and new holdings arise out of the voluntary exchanges and actions of persons. The minimal state is the most extensive state that can be justified. Any state more extensive violates people"s rights (288) Negative liberty is the absence of external constraints or interference from others.
