LAWS 1000 Lecture Notes - Lecture 8: Henry Morgentaler, Homicide, De Facto
Document Summary
There are some crimes in which you will automatically be tried with a jury: ex: first degree murder, treason. There are other instances in which you do not get a choice> you do not get a jury: summary offenses, if you are charged with a very serious crime then you can elect for a jury. You are guaranteed in the charter a right to a trial with a jury. The norm in canada is that there are 12 people that sit on the jury: in some territories you can have smaller juries, civil cases-> you can have a jury but its extremely rare. Descions need to be unanimous: the whole jury needs to find someone guilty or not guilty based on the verdict. If the jury cannot reach a verdict-> mistrial: they repeat the whole process again with a different jury. Juries can suggest a sentence that they feel would be appropriate.
