A professional engineer entered into a written employment contract with a toronto-based civil- engineering design firm. During the engineer"s employment with the design firm, the engineer dealt directly with many of the firm"s clients. The engineer became extremely skilled in preparing cost estimates, and established a good personal reputation within the city of toronto. The engineer terminated the employment contract with the consulting firm after three years, and immediately set up an engineering firm in another part of the city of toronto. The engineer"s previous employers then commenced a court action for an injunction, claiming that the engineer had breached the employment contract and should not be permitted to practise within the city limits.
