Risks: juries can engage is discrimination because of biases (racial, ethnic, gender, attractiveness etc. Juries are made to protect the accused from state power. If the jury is set aside, this becomes null. Common law rule: judge will explain to the jury who will apply facts to the case. Jury"s roll: assessing facts, applying law to the facts, listening to what the judge says and teaches them. Justice ken talks about the organization of the national judicial institute.
