Remember: 3 types of evidence, direct vs hearsay, direct vs circumstantial. What is relevant: any evidence which helps the judge or jury assess the case - decided by the judge. What is admissible: evidence which passes the rules of the court - decided by the judge. What is the weight: the importance of the evidence for deciding the case - decided by the judge/jury. Context: a critical concept for all forensic analyses. Familiar to archaeologists: the context of any recovered physical evidence helps determine its relevance, admissibility and weight, crimes act 1914, section 23wa (5): destruction of forensic evidence involves the destruction of identifying material and context. Csi effect: belief that the most evidence possible needs to be found, not realising how long this takes. The rise of the celebrity expert witness: also benefited from popular newspaper accounts of gruesome murders (eg whitechapel murderer)
