Established duties of care, non-delegable duties of care, Negligence arises where a defendant"s conduct fails to conform to the legal obligation; that is, it falls below the objective standard that is imposed by the law. Tame v new south wales [8] defines negligence as conduct, which involves a failure to conform to a legal obligation and failure to protect the interests of someone with whose interests a defended ought to be concerned. ". Negligence is an action on the case therefore plaintiff has to prove damage to succeed: indirect interference, must suffer damage. Negligence refers to an allegation that the defendant, through their action or omission has caused the plaintiff loss/ damage. That is, the defendant through their lack of care has caused the plaintiff damage. Due to the relationship between the plaintiff and the defendant, there is a duty upon the defendant to have the plaintiff in their thoughts and consideration not to cause them harm to them.
