What are the possible reasons for a lack of use of international contract laws?
Expensive to obtain information
Need to obey multiple legal systems
Lack of knowledge of principles of contract law of other countries
Inconsistent interpretation of contracts
Until you have a case that deals with the issue there will be no discussions unless
there is legislation passed
What are the main characteristics of private international law?
Good Faith, Offer, Acceptance, Parole Evidence Rule- For the purposes of this
Convention statements made by and other conduct of a party are to be interpreted
according to his intent where the other party knew or could not have been unaware
what that intent was.
Do you agree with Mary Keyes with respect to the need for reform?
Australian courts now not the only courts that deal with issues with contracts
because of their internationalisation- therefore we do need to look at more reform
in order to reflect this transition
The increased trade with states such as India and China are very important and
necessary if Australia is to continue as a globalised trading party. Therefore I do
agree with Keyes that by familiarising ourselves with the laws of these countries
and the ways in which they deal with and analyse contracts we would increase our
own potential for trade with them.
